Nosh Kosh imports and distributes food and beverage products sourced internationally for sale in Canada. All products offered on our Website are intended for personal, household or gifting use unless otherwise specified.
Product descriptions
We make every effort to accurately represent our products, including photographs, descriptions, ingredient information and country of origin. However, product packaging, labelling and formulations may be updated by the manufacturer without advance notice to us. In such cases, the information on the physical product label is the definitive and current reference and takes precedence over any other information displayed on our Website.
Product images are provided for illustrative purposes. Actual packaging may differ slightly from images shown, particularly for products where the manufacturer periodically updates design.
Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products or withdraw any product from sale at any time without prior notice. If a product you have ordered becomes unavailable after your order is confirmed, we will contact you promptly and offer a full refund or where possible, a suitable alternative.
Import note: All products sold by Nosh Kosh have been imported in compliance with the Safe Food for Canadians Regulations (SFCR) and meet applicable Canadian labelling and food safety standards at the time of import. We hold all required import licences for the products we sell.
Orders & Payment
Placing an order
When you place an order through our Website, you are making an offer to purchase the selected products at the listed price, subject to these Terms. An order confirmation email does not constitute acceptance of your offer. A binding contract of sale is formed when we dispatch your order and send you a shipping confirmation.
We reserve the right to cancel or refuse any order at any time prior to dispatch, including in cases of suspected fraud, pricing errors or stock discrepancies. If we cancel your order, you will receive a full refund to your original payment method within 5 to 10 business days.
Payment
Payment is required in full at the time of checkout. We accept the payment methods listed at checkout, which are processed securely through Shopify Payments. All transactions are in Canadian dollars (CAD) unless otherwise specified.
By submitting payment, you confirm that you are authorised to use the payment method provided. Nosh Kosh does not store your full payment card details. Payment processing is handled by our payment processor in accordance with PCI DSS standards.
Taxes
Prices displayed on our Website do not include applicable taxes unless explicitly stated. GST and any applicable provincial taxes will be calculated and displayed at checkout based on your delivery address. You are responsible for any import duties, customs fees or additional taxes that may apply if you are ordering from outside Canada, though we note we do not currently ship outside of Canada.
Pricing & Promotions
Prices on our Website are listed in Canadian dollars and are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout.
In the event of a pricing error on our Website, we reserve the right to cancel affected orders and notify you. We are not obligated to fulfil an order at an incorrectly listed price. If you have already paid and we are unable to honour the order at the correct price, we will offer you the option to proceed at the correct price or receive a full refund.
Promotional offers and discount codes
Promotional pricing, discount codes and special offers are subject to their own terms; and are valid only for the period and conditions specified. Only one discount code may be applied per order unless otherwise stated. Promotional offers cannot be applied retroactively to completed orders.
We reserve the right to withdraw or modify promotional offers at any time. Any promotional changes will not affect orders already confirmed.

All products sold by Nosh Kosh are shelf stable, non-perishable goods that have been imported and distributed in compliance with:

Manufacturer changes
As an importer and distributor, Nosh Kosh is reliant on our international suppliers for product formulation, ingredient sourcing and manufacturing practices. Manufacturers may change ingredients, formulations, production facilities or packaging without prior notification to us. While we make every effort to keep product information current, we cannot guarantee that all product details on our Website reflect the most recent iteration of a product at any given time.
The product label as packaged and delivered to you is always the definitive and current reference for ingredient, allergen, nutritional and safety information. You are strongly encouraged to read the product label in full before consuming any product.
Limitation of Liability for Food Safety
To the fullest extent permitted by applicable Canadian law, Nosh Kosh's liability for any claim arising from the consumption or use of a product is limited to the purchase price paid for that product. We are not liable for indirect, incidental, consequential or special damages arising from product use, including adverse reactions or health outcomes, except where such liability cannot be excluded under the Business Practices and Consumer Protection Act or other applicable law.
This limitation does not apply where a product is found to be unsafe, adulterated or in violation of the Food and Drug Act, in which case your full statutory rights apply.
Allergen Information & Dietary Suitability
Many of our products contain or may contain priority allergens as defined under the Food and Drug Regulations, including but not limited to: milk, soy, tree nuts, wheat and sesame. Allergen information is disclosed on each product label and on the corresponding product page of our Website, based on information provided by our suppliers.
Because our products are manufactured in facilities that may also process other allergens and because supplier formulations can change, we cannot guarantee that any product is entirely free from any specific allergen. Cross-contamination risks at the manufacturing level are outside our direct control.

For severe or life-threatening allergies, please consult your healthcare provider before consuming any imported food product. If you have a complaint or dispute about an order, product or our service, please contact us first. We are a small, founder-led business and we want the opportunity to resolve issues directly before formal proceedings are initiated. We commit to responding to all complaints within 5 business days.
